US Executive Order 14110: Safe, Secure, and Trustworthy Development and Use of AI

President Joseph R. Biden · 30 October 2023

Law regulationRescinded

The Biden administration's sweeping 2023 order on AI safety, civil rights, and reporting by frontier developers. It was cancelled on the first day of the Trump administration, though some institutions it created live on in altered form.

What it calls for

  • Safety evaluations
  • Compute governance
  • Transparency
  • Fairness non discrimination
  • Privacy
  • Worker protection

Scope

US federal executive branch; required dual-use model developers above 10^26 FLOP to report red-team results under the Defense Production Act

What actually happened

Rescinded on 2025-01-20 by EO 14148 and replaced by EO 14179 on 2025-01-23 (https://en.wikipedia.org/wiki/Executive_Order_14179). Before rescission it created the US AI Safety Institute (Nov 2023), OMB memo M-24-10, and NIST's dual-use guidance; several agency work products survive under new names (US AISI became CAISI in June 2025, https://www.nist.gov/caisi). Looked for: whether the 10^26 reporting requirement continued - it did not; CAISI now relies on voluntary agreements.
